Terms of Service

These Terms govern your use of the Kiddlo marketplace. By creating an account or using the platform, you agree to be bound by them.

1. About Kiddlo

Kiddlo is an online peer-to-peer marketplace that enables parents and carers in the United Kingdom to buy and sell pre-loved baby and children's items. The platform is operated by Kiddlo Ltd, a company registered in England and Wales ("Kiddlo", "we", "us", "our"). By accessing or using Kiddlo you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the platform.

2. Eligibility

To use Kiddlo you must:

  • Be aged 18 or over You must be at least 18 years old to register an account or complete transactions on Kiddlo.
  • Be a UK resident Kiddlo is currently available to residents of the United Kingdom only. Access from outside the UK is not supported and may be restricted.
  • Have legal capacity You must have the legal capacity to enter into a binding contract under the laws of England and Wales.
  • Provide accurate information All information you provide during registration and throughout your use of the platform must be accurate, current, and complete.

3. Account registration

When you create a Kiddlo account you are responsible for:

  • Keeping your credentials secure You are solely responsible for maintaining the confidentiality of your password. Do not share your login details with anyone. Kiddlo will never ask for your password.
  • All activity under your account You are responsible for all activity that occurs under your account, whether or not you authorised it. Notify us immediately at support@kiddlo.co.uk if you suspect unauthorised access.
  • One account per person You may only hold one Kiddlo account. Creating multiple accounts — including to circumvent a suspension — is prohibited and may result in permanent removal from the platform.
  • Not impersonating others You must not create an account using a false identity, impersonate any person, or misrepresent your affiliation with any entity.

4. Kiddlo's role as a marketplace

Kiddlo is a technology platform that facilitates transactions between independent buyers and sellers. Kiddlo is not a party to any contract of sale between buyers and sellers, and does not buy, sell, hold, or take title to any items listed on the platform. Accordingly:

  • Sellers are independent Each seller is an independent individual acting in a private capacity or, where applicable, as a consumer-to-consumer seller. Sellers are not agents, employees, or representatives of Kiddlo.
  • Kiddlo does not verify items Kiddlo does not inspect, verify, or guarantee the accuracy, quality, safety, or legality of items listed. The 'Verified Safe' badge relates to seller identity checks only and does not constitute a warranty of the item's condition or compliance.
  • Contracts are between users The legal contract for the sale of an item is formed directly between the buyer and the seller. Kiddlo facilitates but is not a party to that contract.
  • Kiddlo may act as limited payment agent For the purpose of collecting payments, Kiddlo (or its payment processor, Stripe) acts as a limited payment collection agent for sellers. Receipt of funds by Stripe on a seller's behalf satisfies the buyer's payment obligation to the seller.

5. Listing items for sale

As a seller, you agree to the following obligations when creating a listing:

  • Accuracy All listing information — including title, description, photographs, condition, price, and location — must be accurate, complete, and not misleading. You must not use stock images or images belonging to others without permission.
  • Ownership & right to sell You must own the item or have full legal authority to sell it. Listing stolen goods, items subject to a finance agreement, or items you do not have the right to sell is strictly prohibited.
  • Condition You must accurately describe the condition of each item using Kiddlo's condition categories (New with tags, New without tags, Like new, Good, Fair) and disclose any defects, damage, recalls, or safety issues.
  • Recalled & unsafe items You must not list any item that has been subject to a product safety recall by the manufacturer, Trading Standards, or the Office for Product Safety and Standards (OPSS), or any item that is otherwise unsafe for its intended use.
  • Legal compliance All listings must comply with applicable UK laws including the Consumer Protection Act 1987, the General Product Safety Regulations 2005, and the Sale of Goods Act 1979 (as applicable to consumer-to-consumer sales). You are solely responsible for ensuring your listings comply with the law.
  • Fulfilling sales Once a buyer completes payment, you are obligated to fulfil the sale promptly. Repeatedly accepting payment and failing to send items, or cancelling without good cause, will result in account suspension.

6. Prohibited items and conduct

The following are strictly prohibited on Kiddlo. Violation may result in immediate account termination and, where appropriate, referral to law enforcement:

  • Recalled or unsafe products Any product subject to a safety recall, any item that fails to meet applicable UK safety standards, or any item that poses a foreseeable risk of harm to a child.
  • Counterfeit or infringing goods Items that infringe third-party intellectual property rights, including counterfeit branded goods.
  • Hazardous materials Any item containing or constituting a hazardous material, including items with excessive lead content, phthalates above legal limits, or prohibited chemicals.
  • Offensive or illegal content Content that is defamatory, obscene, discriminatory, or otherwise unlawful under UK law.
  • Fraud & manipulation Creating fake reviews, inflating listing views, offering to transact outside the platform to avoid fees, or any other form of fraudulent or deceptive conduct.
  • Harassment & abuse Harassing, threatening, or abusing other users via Kiddlo's messaging system or any other channel connected to transactions on the platform.
  • Weapons & illegal items Weapons, controlled substances, prescription items, illegal knives, or any item whose sale is prohibited or restricted under UK law.

7. Buying on Kiddlo

As a buyer, you agree to the following:

  • Review listings carefully You are responsible for reading listing descriptions, viewing all photographs, and asking the seller questions before purchasing. Kiddlo does not verify item descriptions.
  • Payment obligation When you complete a purchase, you enter into a binding contract with the seller and are obligated to pay the stated price plus any applicable fees. Payments are processed via Stripe and are subject to Stripe's terms.
  • Consumer rights Your statutory rights under UK consumer law apply to transactions with sellers who qualify as traders. For consumer-to-consumer (private) sales, statutory rights under the Consumer Rights Act 2015 are more limited. Kiddlo's Buyer Protection programme supplements (but does not replace) your legal rights.
  • Communication via Kiddlo All pre- and post-sale communication must take place through Kiddlo's messaging system. Sharing contact details or arranging off-platform payments is prohibited and voids Buyer Protection.

8. Buyer Protection

Kiddlo's Buyer Protection programme is designed to give buyers confidence when purchasing on the platform. The following conditions apply:

  • Coverage Buyer Protection covers purchases where the item does not arrive, arrives significantly not as described, or is unsafe. Protection applies only to payments made through Kiddlo's checkout.
  • Raising a dispute To raise a dispute, buyers must contact Kiddlo within 3 days of the confirmed delivery date (or within 3 days of the estimated delivery date if tracking shows no delivery). Disputes raised outside this window may not be eligible.
  • Funds hold Seller funds are held in escrow until the buyer confirms receipt or the release window expires. Kiddlo reserves the right to extend the hold period during an active dispute.
  • Resolution Kiddlo will review evidence from both parties and issue a decision within 5 business days. Kiddlo's decision is final and binding on both parties. Kiddlo reserves the right to refund the buyer, release funds to the seller, or split as appropriate.
  • Exclusions Buyer Protection does not cover: items collected in person without using Kiddlo's checkout; payments made outside the platform; buyer's remorse or change of mind; minor discrepancies that do not materially affect the item's use; or disputes raised after the eligibility window.
  • Protection fee A protection fee is charged to the buyer at checkout. This fee is non-refundable except where Buyer Protection is successfully claimed.

9. Fees and payments

Kiddlo charges the following fees:

  • Buyer Protection fee A fee charged to buyers at checkout, calculated as a percentage of the item price. The exact fee is displayed before payment is confirmed.
  • Seller fees Kiddlo may charge a commission on completed sales. Current fee rates are published on our Pricing page. Kiddlo reserves the right to change fees with reasonable notice.
  • Payment processing All payments are processed by Stripe. By using the checkout you agree to Stripe's Terms of Service. Kiddlo does not store card details.
  • Seller payouts Funds are released to sellers following successful delivery confirmation or expiry of the Buyer Protection window, whichever is earlier. Payout timelines depend on your bank and may take 3–5 business days.
  • Taxes Sellers are responsible for determining and accounting for any tax obligations arising from their sales activity on Kiddlo, including VAT where applicable. Kiddlo does not provide tax advice.

10. Returns and refunds

Kiddlo operates as a peer-to-peer marketplace for pre-owned items. The following return policy applies:

  • No statutory right to cancel (private sellers) Consumer Contracts Regulations 2013 rights to cancel (14-day cooling-off period) do not apply to private consumer-to-consumer sales. Buyers should review listings carefully before purchasing.
  • Item not as described If an item materially differs from its listing description, buyers may raise a dispute under Buyer Protection within the eligibility window. Where the dispute is upheld, a refund will be issued.
  • Seller return policies Individual sellers may offer voluntary returns at their discretion. Any seller return policy is in addition to, and does not replace, your rights under Buyer Protection.
  • Refund processing Approved refunds are returned to the original payment method and typically appear within 5–10 business days depending on your card issuer.

11. Intellectual property

All intellectual property rights in the Kiddlo platform — including the name, logo, software, design, and content created by Kiddlo — are owned by or licensed to Kiddlo Ltd. You must not copy, reproduce, redistribute, or create derivative works from any Kiddlo content without our prior written permission.

  • Your content By uploading photographs or text to Kiddlo, you grant Kiddlo a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purpose of operating and promoting the platform. You retain ownership of your content but warrant that you have the right to grant this licence.
  • Reporting infringement If you believe your intellectual property rights have been infringed by a listing, contact us at legal@kiddlo.co.uk with full details. We will investigate and remove infringing content where appropriate.

12. Limitation of liability

To the fullest extent permitted by applicable law:

  • No warranties Kiddlo provides the platform on an 'as is' and 'as available' basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Platform availability Kiddlo does not guarantee uninterrupted or error-free operation of the platform. We may suspend, restrict, or terminate access at any time for maintenance, legal compliance, or any other reason.
  • Cap on liability Kiddlo's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the greater of (a) the total fees paid by you to Kiddlo in the 12 months preceding the claim, or (b) £100.
  • Excluded losses Kiddlo shall not be liable for any indirect, incidental, special, consequential, or punitive losses, including loss of profit, loss of revenue, loss of data, or loss of goodwill, whether arising in contract, tort, or otherwise.
  • Statutory rights preserved Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kiddlo Ltd, its directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the platform; (b) your listings, content, or conduct; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.

14. Suspension and termination

Kiddlo reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we reasonably believe that:

  • Breach of Terms You have breached or are likely to breach these Terms or any applicable law.
  • Fraudulent activity Your account shows signs of fraudulent, abusive, or suspicious activity.
  • Risk to users or platform Continued access poses a risk to the safety, security, or integrity of other users or the platform.
  • Legal obligation We are required to do so by a court order, regulatory requirement, or other legal obligation.

You may close your account at any time by contacting support@kiddlo.co.uk. Closure does not affect any pending transactions, obligations, or liabilities arising before closure.

15. Changes to these Terms

We may update these Terms from time to time to reflect changes in the law, our services, or business practices. When we make material changes, we will notify you by email or by posting a prominent notice on the platform at least 14 days before the changes take effect. Continued use of Kiddlo after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the platform and close your account before the changes take effect.

16. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of Kiddlo shall be subject to the exclusive jurisdiction of the courts of England and Wales, subject to your statutory rights as a consumer. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of those jurisdictions. Before commencing formal proceedings, we encourage you to contact us at support@kiddlo.co.uk to resolve the matter informally.
